Fines under occupational safety law (§ 25 ArbSchG)
Up to €30,000 fine for a missing risk assessment.
Under § 25 (1) no. 2a ArbSchG a fine of up to €30,000 may be imposed where there is no proper risk assessment. For GB Psych the assessment is calibrated against severity, business size and repeated breaches. In parallel, GDPR fines (Art. 83) apply where self-collected data is processed unlawfully.

Three parallel fine streams
A business that omits or incorrectly runs the GB Psych can face three independent fines. First § 25 ArbSchG: up to €30,000 for a deficient or missing risk assessment. Second Art. 83 (5) GDPR: up to €20m or 4 % of global annual turnover for breaches of Art. 5, 6 or 9. Third § 43 BDSG: up to €50,000 for breaches of employee data protection.
