GDA inspection rates by German state (2023/2024)

National average: 44.7 % of inspection targets achieved.

The Arbeitsschutzkontrollgesetz (Occupational Safety Inspection Act) makes a minimum inspection rate of 5 % of all establishments per year mandatory from 2026. Reality is well below: Baden-Württemberg achieved only 19 % of its target for GDA system inspections in 2023, the federal average was 44.7 %. The gap is the basis of the expected catch-up effect from 2026.

The legal basis

The Arbeitsschutzkontrollgesetz of 22 December 2020 added § 21 (1a) ArbSchG: state inspectorates must inspect at least 5 % of all establishments per year. The provision applies from 2026. The previous federal average density was around 1 % per the BMAS interim report — the target therefore implies a fivefold increase in inspection density.

  • Existence of a written, current risk assessment (§ 5 ArbSchG)
  • Inclusion of mental load (§ 5 (3) no. 6 ArbSchG)
  • Differentiation by activity area — no blanket coverage
  • Action loop including effectiveness review (§ 3 ArbSchG)
  • Complete documentation (§ 6 ArbSchG)
